Jaipur, April 26, 2024: The Rajasthan High Court, Jaipur Bench, has dismissed the application filed by M/s Arco Electro Technologies Pvt. Ltd. in relation to the winding-up order of M/s Vanasthali Textiles Industries Ltd., which is currently in liquidation.
The matter was called for hearing, but the applicant, M/s Arco Electro Technologies Pvt. Ltd., failed to mark its attendance, prompting serious objections from the opposing side. The counsel for the non-applicant/respondent, the Official Liquidator and Registrar of Companies, raised an important point regarding the applicant’s appeal against the winding-up order. The respondent’s counsel highlighted that the applicant had already filed an appeal before the Division Bench against the winding-up order dated November 7, 2017, making the claim of non-communication and lack of awareness regarding the order misleading.
In light of the absence of the applicant’s counsel and the facts presented, the court found no grounds to entertain the application. Consequently, the court dismissed the present application.
The petitioner, M/s Arco Electro Technologies Pvt. Ltd., had sought relief in the matter of the winding-up proceedings against M/s Vanasthali Textiles Industries Ltd., which is currently in liquidation. The court, however, emphasized that the applicant’s failure to attend and the existing appeal already pending before the Division Bench led to the dismissal of the application.
