When an employee who is resigning from the post wherein he is working in permanent capacity shall be liable to submit a three months prior notice of his resignation or has to deposit the gross salary of three months whichever he prefers as per rules. Permanent capacity means the employee has cleared his probation period in that department. Similarly, if an employee is working in temporary capacity on any post and wants to resign then the notice period shall be one month. Temporary capacity means when the employee is in under probation period in that department.
As per the condition no. 5 of Temporary Service Rule 1965, the services may be terminated under these rules. Under Rule 5 (1) the services of a temporary Govt. servant is liable to terminate at any time by a notice in written given either by Govt. servant to the appointing authority or by the appointing authority to the Govt. servant. The period of such notice will be of one month, however if letter of resignation submitted without any reference direct or indirect to the rule 5, the period of duties will be automatically expire and the resignation letter will require the acceptance in order to become effectiv
