Odisha property registration procedure is governed by the Registration (Odisha Amendment) Act, 2013. Any transactions that involve the sale of the immovable property should be registered to ensure clear transfer of title to the property owner. Once the registration of transaction of immovable property has been done, it becomes a permanent public record. Odisha property registration process involves the preparation of documents, paying the applicable stamp duty and registration charges for the deed to be legally recorded in the state. The Revenue & Disaster Management Department manages the registration or transfer of property in Odisha.
Registration (Odisha Amendment) Act, 2013
Registration (Odisha Amendment) Act provides details regarding the method of registering documents, information regarding legal rights and obligations affecting the particulars of immovable property. According to this registration act, the immovable property includes land, buildings, lights and fisheries.
Section 17 Registration (Odisha Amendment) Act – Compulsory Registration
Section 17 of Registration (Odisha Amendment) Act governs the different categories of the deed for which registration is compulsory. The deed relating to the some of the transactions of immovable properties is required to be compulsorily registered. Such transactions are listed bellows:
- Instruments of the gift of immovable property
- Instruments which extinguish or create any right or title to or in a property of a value of above one hundred rupees.
- Lease of property for any term exceeding twelve months or from year to year
Section 18 of Registration (Odisha Amendment) Act – Registration Optional
Section 18 of the Registration (Odisha Amendment) Act governs the deed of which registration is optional, that is given here:
- Instruments (other than instruments of wills and gifts) relating to the transfer of immovable property, the value of which is less than Rs.100.
- Instruments are acknowledging the receipt or payment of any consideration.
- Lease of immovable property for a term less than one year.
- Instruments are transferring any decree or order of a court where the subject matter of such decree or order is immovable property, the value of which is less than one hundred rupees.
Purpose of Odisha Property Registration (Deed Registration)
- According to the Odisha transfer of property act right, title or interest can be acquired only if the deed is registered.
- The deed registration will be a permanent public record once it’s registered with the concerned office of Sub-Registrar.
- Anyone can inspect the public record of the transfer of property and can obtain from the Sub –Registrar office.
- Registration of property is giving the information to the general public that the ownership title has transferred to the buyer (new owner).
- Property registration enables the public to verify whether the property has been previously encumbered during the transfer of ownership.
- If a person intends to buy a property in Odisha, he/she can easily verify the record-index available in the sub-Registrar office. Such a person can ascertain in whose name the last transfer deed has been registered.
Note: As per the Odisha Registration Act, if a property has not been registered in, then such property will not be admissible as evidence in a court of law.
Documents Required Odisha Property Registration
- All supporting documents relating to the ownership of the transacted Property
- Valid photo identity proof documents of all the executants, claimants and identifier (EPIC, Aadhaar, Driving License, Passport or PAN)
- Three passport size photographs of all the executants and claimants
- Copy of PAN Card of the executants and claimants (if the document is valued more than 10 (ten) lakhs
- In the absence of PAN card, Form No. 60 under Income Tax Act
- Encumbrance Certificate from the date of publication of the ROR published
- Declaration in prescribed format duly signed by transferor and transferee, if no building or structure exists on the transacted property.
- Declaration in prescribed format duly signed by transferor and transferee, If any house or structure exists on the transacted property.
- In case of the document is registered by an Attorney Holder – Registered Power of Attorney and Photo identity proof document of the Attorney Holder
- Requisite permission from the Revenue Officer when an SC/ST person transfers the property in favour of a non- SC/ST person
- Requisite permission or NOC issued by the Competent Authority of Endowments for transfer of property belonging to deity.
Stamp Duty for Odisha Property Registration
Stamp duty is one of the legal tax payable as proof for any transaction involves the immovable property. The rate of stamp duty payable for property registration in Odisha is 5% of the market value of land for all citizens except women.
Stamp Duty for Women Owner- Women in Odisha have to pay less stamp duty during property deals in their names, and the rate of Odisha property registration is 4% of the market value of land.
User Registration Fee- For registering property online in Odisha, the owner or applicant needs to pay a registration fee to Government.
Prescribed Authority
The deed has to be presented for registration at the office of the Sub-Registrar within whose sub-district the whole portion of the property to which such report relates is situated.
Prepare a Deed
Before applying for property registration, the document needs to be prepared. Deed preparation for certification can be done personally written by the executants or through Deed writers by paying the applicable fee. Fee for document writers is based on the value of the property specified in the document.
The language of a deed presented for registration should be in an expression commonly used in the district existing in Odisha.
Note: The SRO empowered to refuse to register the deed if the language prescribed in the deed is not commonly used in the district unless an accurate translation accompanies the report into the language widely used in the region and also by a true copy.
Download Deed
To download Deed format for registering deed in Odisha, the applicant needs to visit the official website of Revenue & Disaster Management Department. From the home page click on Model deed option, the link will redirect to new page.
In the new page, the applicant can download the required deed as per the type of transaction of immovable property.
Take a print out of the suitable deed format, after providing details scan the documents in PDF format for uploading while applying online for property registration.
Calculate Stamp Duty Online
Step 1: To view the applicable stamp duties and registration fee, access the homepage page of Odisha Revenue department web portal.
Step 2: Select Registration and Stamp Duty calculator option from Citizen Corner. The link will redirect to new page.
Step 3: In the new page select District, Registration Office, Village – Thana and Unit from the drop-down menu.
Step 4: Provide a plot number and area details. By clicking on the search button, the stamp duty for concerned property registration will be displayed.
Pay Stamp Duty through SHCIL
The applicant needs to approach an ACC appointed by SHCIL (Stack Holding Corporation of India limited) and fill up an application form as the prescribed form in the e-Stamping system.
After submitting the application form, the ACC will enter the details into the system, and a Stamp Certificate will be generated immediately.
Note: Stamp Certificate is generated only after realisation of funds. Keep safe the stamp certificate (e-Stamp); it has to submit at the time of visiting registrar office.
Application Procedure for Odisha Property Registration
Access IGR ODISHA
Step 1: For registering property in Odisha visit official website of Revenue & Disaster Management Department – IGR ODISHA
Step 2: Select Property/Document submission option for applying for online property registration.
Step 3: By clicking on this, a small window will be displayed, click on the online application option.
Step 4: The link will redirect to a new page, register in the portal for availing certificate services provided by the Government. Provide following details for user registration in IGR Odisha.
- User Name
- Date of Birth
- E-Mail ID
- Mobile Number
- Login ID
- Password
- Security Question
Step5: Click Submit Button for registration, after one-time submission password (OTP), will be sent to the registered mobile number, Provide the OTP in the box given and click confirm button.
Step 6: Confirmation mail will be sent to registered mail ID. Click on the activation link to activate your account.
Step 7: After activation, the applicant can log in to the portal using username and password.
Provide Property Registration Details
Step 8: Once the applicant login to the portal, you can provide details for Odisha property registration such as details like Seller, Buyer, Identifier, Consenter, witness and property details.
Upload Documents
Step 9: Upload all supporting documents as mentioned above along with the deed prepared for registration. Click on upload & save button after uploading the documents. Once finished click on ‘done and exist.’
Step 10: Once all the documents are uploaded, and details are provided click on the next button. The stamp duty payable for Odisha property registration will be calculated automatically and displayed on the screen.
Step 11: The acknowledgement slip with a reference number will be displayed. Note it for future reference. At the same time application will be forward to concerned sub-registrar officer login for verification.
Document Verification
Step 12: Once the application is submitted, the registrar officer will verify the documents and information furnished. If the application is accepted, Ok the applicant need to pay registration fee through online treasury portal.
Online Payment of Registration Fee
Step 13: Applicant can pay registration fee through treasury portal. From IGR Odisha page click on ‘Online Payment of Registration Fees’, the link will redirect to Treasury portal.
Step 14: Provide details and make payment online. After successful payment, you can get e-Challan. It needs to be submitted to SRO at the time of verification.
Time Slot Booking
Step 15: After payment, you will be redirected IGR site, click on Time slot booking button. Select the convenient date from the list shown for approach SR office.
Once the time slots are selected, OTP will be sent to the registered mobile number and enter the same for booking the time slot. Note: In case OTP is not received enter the mobile number and click on OTP.
Allotment of Date and Time
Step 16: As per convenience, the concerned officer will allow time and date for verification to the applicant.
Approach SRO office
Step 17: On the allotted date, the applicant has to visit concerned Sub Registrar Office with stamp certificate and e-challan and acknowledgement slip.
Verification by SRO
Step 18: Sub registering officer will verify the following details.
- Documents verification
- Oral verification of Transaction
- Checking of entries made by the applicant
- Examination of stamp certificate and e-challan
Step 19: Upon verification, the SRO will update details Odisha land records (Bhulekh) website.
Note: If SRO rejects the application, Return Deed with reasons for rejection will be updated online through the portal.
Recording Photo and Bio-Metrics
Step 20: Once the Sub-Registrar marked the deed it will be fetched into the online land records and deed data and Photograph of the buyer, seller, witnesses and identifiers will be recorded in the system.
Step 21: SRO officer will regularise the party details form by obtaining the sign and Biometrics of the buyer & seller.
E-Registration
After successful registration, the registrar will update details online (re-registration). For e-registration, the applicant needs to pay the fee as mentioned.
Application Status
Step 22: Odisha property registration status will be updated through SMS and registered mail ID. The applicant can also check application status by visiting IGR Odisha home page. Click on Application track status.
Step 23: Provide the application ID and Click on status, the application status will be displayed.
